Terms of Service

Last updated: 21 September 2026

These terms cover trendsignalmedia.net and the business marketing services of TRENDSIGNALMEDIA LIMITED (TrendSignalMedia, we, us or our), incorporated in Hong Kong with limited liability. Hong Kong registration number: 81260081. Registered office: FLAT 2304, 23/F, HO KING, COMM CENTRE, 2-16 FA YUEN STREET, MONG KOK, HONG KONG. Contact: trendsignalmedialtd@gmail.com.

1. Scope and your service agreement

Our services are offered to businesses. Sending an enquiry or booking a call does not purchase a service or create a paid engagement. The scope, deliverables, start date, fees, billing currency, term and cancellation notice must be agreed in a written proposal, order or service agreement accepted by both parties. These service terms apply to an engagement only when incorporated into that agreement. A signed service agreement takes precedence over conflicting provisions here, subject to applicable law.

2. Services and performance

Services may include advertising creative, campaign management, strategy, funnels, reporting and growth systems, as specified in the agreed scope. We will exercise reasonable care and skill. Work outside the agreed scope requires written agreement on any additional fees and timing.

We do not guarantee a particular revenue, profit, return on advertising spend, lead volume, conversion rate or platform approval. Results depend on factors including the offer, market, budget, client implementation and third-party platforms. Case studies illustrate particular past outcomes and are not promises of future results. A fee linked to advertising spend does not itself create a performance guarantee.

3. Fees, advertising spend and payments

Our fees may include a retainer and a percentage of advertising spend attributable to agreed creatives or campaigns. Each client’s written agreement sets the amounts and percentage, eligible ads, measurement source, calculation period, allocation of spend, treatment of platform adjustments, payment dates, renewal terms and applicable taxes. No fixed fee or percentage is created by this website.

Advertising budgets and approved third-party costs are separate from our fees unless expressly included. Clients remain responsible for charges incurred in their advertising accounts. We will not materially increase an agreed advertising budget without authorization. Payments may be processed through Stripe under its applicable terms. Billing questions can be sent to our business email.

4. Cancellations and refunds

Once agreed work has started, fees for that work and committed service capacity are non-refundable for a change of mind, dissatisfaction with results alone, or failure to achieve a commercial target, to the extent permitted by law. Cancellation notice, minimum commitments and any renewal arrangements are set separately in the signed service agreement; cancelling does not reverse fees already earned or authorized costs already incurred.

This policy does not exclude refunds or other remedies required by law, amounts charged in error, remedies for our breach, or refunds expressly promised in writing. If we end an engagement without client breach and do not provide prepaid services, we will refund the unearned balance after accounting for work completed and authorized, non-recoverable costs. We do not sell physical goods through this website, so there is no physical-product return process.

5. Client responsibilities and approvals

Clients must provide accurate instructions, timely feedback and approvals, appropriate account access, and materials they are entitled to use. Clients must substantiate product claims and ensure that their products, offers and supplied content comply with applicable law and platform policies. Client approval does not excuse our own legal obligations. Delayed inputs or access can affect delivery dates; we will communicate material changes.

Access to client accounts is limited to the agreed services. Clients should grant role-based access where possible and retain ownership and administrative control of their accounts. Clients must not send unnecessary sensitive personal information or passwords to our general enquiry email.

6. Intellectual property

Each party retains its pre-existing intellectual property. Clients grant us permission to use their supplied materials only as needed to deliver the agreed services. Ownership or licensing of final deliverables, working files and any third-party assets will be specified in the signed service agreement and may depend on full payment. Our existing tools, methods and reusable templates remain ours. We will obtain permission before using identifiable client work, logos or confidential results in public marketing.

7. Confidentiality and personal information

Each party must protect the other’s non-public business information and use it only for the engagement, except where disclosure is authorized or required by law. Necessary disclosures to people assisting with the work must be subject to appropriate confidentiality obligations. Information already public without breach, independently developed, or lawfully received from another source is not confidential under this clause.

Our Privacy Policy explains how we handle personal information for website enquiries and business administration. If services involve personal information processed on a client’s instructions, the parties must agree on appropriate responsibilities, permissions and data-processing terms. These website terms do not authorize unrestricted use of customer or lead data.

8. Third-party platforms and interruptions

Advertising networks, hosting providers, payment services and other third parties operate under their own terms. Their approval decisions, outages and policy changes may affect delivery or results. We are not responsible for events outside our reasonable control, but will take reasonable steps to communicate material impacts and mitigate them. This does not exclude responsibility for our own breach or failure to exercise reasonable care.

9. Suspension and ending an engagement

An engagement may be suspended or ended in accordance with its signed agreement, including for material breach, non-payment or unlawful instructions. Where reasonable, notice and an opportunity to remedy the issue will be given; urgent action may be taken to address a security threat or unlawful activity. Accrued payment, confidentiality and intellectual-property obligations survive termination where applicable. Handover and the treatment of remaining prepaid fees follow the agreement and section 4.

10. Website use

You may use this website for lawful business purposes. Do not attempt unauthorized access, disrupt the site, introduce malicious code, impersonate another person, or copy materials in a way that infringes intellectual-property rights. Website information is general information and is not a binding quotation. External links are provided for convenience; the linked services are governed by their own terms.

11. Liability and rights that cannot be excluded

Any agreed limits on liability for paid services must be stated in the signed service agreement and apply only to the extent that they are lawful and reasonable. Nothing in these terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any liability or statutory right that cannot lawfully be excluded or limited. A website disclaimer does not remove obligations to deliver contracted services with reasonable care and skill.

12. Disputes and governing law

Please first send a written description of any concern to trendsignalmedialtd@gmail.com so we can try to resolve it promptly. Unless a signed service agreement provides otherwise, these terms are governed by Hong Kong law and the courts of Hong Kong have non-exclusive jurisdiction. Mandatory legal protections and any right to bring a claim in another competent forum are preserved.

13. Changes and general provisions

We may update these website terms prospectively and show the revised date. Changes do not alter an existing signed agreement without the agreement or notice required by that contract and applicable law. If a provision is unenforceable, the remainder continues to apply to the extent lawful. A delay in exercising a right is not a waiver of that right.
